Terms & Conditions
For the design, engineering and manufacture of true-to-scale 3D-printed models. Last updated: September 2026.
1. Scope
These terms apply to all contracts between Ambrosia e.U. („Contractor") and the client for the design, engineering and manufacture of 3D-printed models. Deviating terms of the client apply only with express written consent.
2. Subject of services
The subject is the creation of true-to-scale models from data supplied by the client (plans, drawings, photos, dimensions) or their reconstruction. The specific scope follows from the respective quote.
3. Quote & conclusion of contract
Quotes are non-binding. The contract is concluded with the written order confirmation or approval of the fixed-price quote by the client. The free data review does not yet constitute an order.
4. Prices & payment
The fixed prices stated in the quote apply (net plus 20% VAT). Unless agreed otherwise, a deposit of 50% of the order value is due on placing the order; the balance is payable on delivery. Invoices are due within 14 days of the invoice date without deduction; statutory default interest applies in the event of late payment.
5. Client cooperation & data
The client provides the documents required for implementation and warrants being entitled to use this data. Delays caused by missing or incorrect data are not at the Contractor's expense.
6. Lead time, shipping & transfer of risk
Delivery dates are committed in the quote and begin with the client's approval of the model preview. Express production for a surcharge is possible by agreement.
Models are shipped in protective packaging or handed over as agreed. Towards businesses, risk passes on handover to the carrier; towards consumers, only on handover to the consumer (§ 7b KSchG). Please report transport damage to us promptly, ideally with photos.
7. Approval & acceptance
Before printing, the client receives a preview for approval. With approval, the depicted properties are deemed agreed. Subsequent change requests may cause additional costs and longer lead times.
8. Ownership, rights of use & confidentiality
Until full payment, the delivered model remains the property of the Contractor (retention of title). The 3D construction data created during reconstruction remain with the Contractor; the 3D file is released only under a separate, expressly agreed and remunerated arrangement.
Documents supplied by the client (plans, drawings, photos, CAD data) are treated as confidential, used solely to carry out the order and not passed on to third parties. We use images of the finished model as a reference only with the client's express consent.
9. Warranty & liability
Statutory warranty rules apply. Liability for slightly negligent damage to property is excluded to the extent legally permissible. Towards businesses, liability for grossly negligent damage is limited in amount to the respective order value; liability for intent remains unlimited. No liability is assumed for the accuracy or freedom from third-party rights of client-supplied data. Liability for personal injury and under mandatory statutory provisions (in particular the Product Liability Act) remains unaffected.
10. Withdrawal & cancellation
The models produced are individualised items made to customer specification. In distance selling to consumers there is therefore no 14-day right of withdrawal pursuant to § 18(1)(3) FAGG. If the client cancels after conclusion of the contract, engineering and manufacturing work already performed is to be remunerated pro rata.
11. Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards businesses, the place of jurisdiction is — where permissible — the court with subject-matter jurisdiction for the Contractor's registered office (1160 Vienna); towards consumers, the statutory places of jurisdiction apply. Towards consumers, these terms apply only insofar as the Austrian Consumer Protection Act (KSchG) or other mandatory consumer protection provisions do not conflict; mandatory protective provisions of the state in which a consumer has their habitual residence remain unaffected. Should individual provisions be invalid, the contract remains otherwise effective.
